Gwithva

Terms of Service

Gwithva Software Limited · Effective 13 August 2026 · Version 2.0

Effective date: 13 August 2026 Version: 2.0

1. Who we are

Gwithva ("Gwithva", "we", "us", "our") is operated by Gwithva Software Limited, a company registered in England and Wales (company number 17380016) with its registered office at Gwithva Software Limited, Unit A, 82 James Carter Road, Mildenhall, IP28 7DE. You can contact us at [email protected].

2. About these terms

2.1 These Terms of Service ("Terms") govern your use of the Gwithva website, app and related services (the "Platform"). By creating an account, ticking the acceptance box, or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2.2 These Terms apply to two types of user:

We use "you" to mean whichever applies to you.

2.3 We may update these Terms. If we make material changes we will notify you and, where required, ask you to accept the new version. The current version always applies to your use from the date shown above.

3. What Gwithva is — and what it is not

3.1 Gwithva is a platform and software tool. We provide technology that lets Service Providers manage their work and lets Customers find and book cleaning services. We are not a cleaning company.

3.2 The cleaning contract is between the Customer and the Service Provider. When a Customer books a clean, the contract for that cleaning service is formed directly between the Customer and the Service Provider. We are not a party to it. We do not employ Service Providers, do not supervise their work, and do not guarantee the quality, safety, legality or timing of any cleaning service.

3.3 We do not set the price of cleaning services or the terms a Service Provider offers; Service Providers are independent and responsible for their own pricing, tax, insurance and compliance with the law.

4. Eligibility

4.1 You must be at least 18 years old and able to enter into a legally binding contract.

4.2 Service Providers must be lawfully entitled to provide cleaning services in the UK and are responsible for holding any registrations, licences and insurance that apply to their work.

4.3 Insurance. Service Providers are responsible for ensuring they hold any insurance they consider appropriate for the services they provide. Gwithva does not require, verify, or guarantee insurance cover of any kind. Any decision to hold insurance, and any arrangement of cover, is a matter for the Service Provider alone. Customers should satisfy themselves about a Service Provider's insurance position directly if it matters to them. Gwithva accepts no liability arising from a Service Provider's insurance or lack of it.

4.4 We do not verify users. Gwithva does not carry out criminal-record (DBS) checks, identity verification, or checks on the references, qualifications or insurance of any Service Provider, and does not vet or approve users. Users deal with each other at their own discretion. See our Safeguarding statement for more.

5. Your account

5.1 You must provide accurate, current and complete information when you register and keep it up to date.

5.2 You are responsible for keeping your login details secure and for all activity under your account. Tell us at [email protected] without delay if you think your account has been compromised.

5.3 You may not share your account, create an account for someone else without authority, or use another user's account.

6. Acceptable use

You agree not to:

7. Bookings, payments and fees

7.1 Customers can request and book cleaning services through the Platform. Service Providers can accept, decline or arrange bookings.

7.2 For new-customer bookings the Platform facilitates payment for, Gwithva charges the Customer a platform service fee in addition to the Service Provider's quoted price, and the Service Provider receives their quoted price in full (subject to Stripe's own transaction charges and to refund/clawback reversals). This is set out in the Fees & Commission terms (section 4 of the legal pack). There is currently no subscription or listing fee.

7.3 Where the Platform facilitates payment for a cleaning service, payment is processed by Stripe. We do not store full card details.

7.4 You must not use the Platform to find a counterparty and then deliberately move the relationship off‑platform to avoid fees, where fees would otherwise be payable.

8. Content you provide

8.1 You keep ownership of the content you upload (for example, your profile, photos, reviews, messages and client details). You grant us a non‑exclusive, worldwide, royalty‑free licence to host, store, display and use that content only as needed to operate and improve the Platform.

8.2 You confirm you have the right to provide any content and personal data you upload, including any client details a Service Provider adds, and that doing so does not breach anyone's rights or the law.

9. Our intellectual property

The Platform, including its software, design, branding and the Gwithva name and logo, belongs to us or our licensors. Nothing in these Terms transfers any of those rights to you. You may use the Platform only as permitted by these Terms.

10. Reviews and ratings

Reviews must be honest, based on a genuine experience, and must not be unlawful, abusive or misleading. We may remove or hide any review or rating we reasonably believe to be fraudulent, fake, abusive, misleading, or in breach of these Terms or the Acceptable Use Policy. You must not offer incentives for positive reviews or attempt to manipulate ratings.

11. Disputes between users

Any dispute about a cleaning service is between the Customer and the Service Provider. We are not responsible for resolving it, but we may, at our discretion, provide information to help and may suspend accounts where our Terms have been breached.

12. Availability

We aim to keep the Platform available but do not guarantee uninterrupted or error-free availability. We may suspend, restrict or withdraw all or part of the Platform for maintenance, updates or security, and will try to limit disruption. We are not liable for any loss resulting from planned maintenance, technical faults, downtime, or events outside our reasonable control.

13. Our liability

13.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited.

13.2 Because Gwithva is a platform and not the cleaning provider, we are not liable for the acts, omissions, quality or conduct of any Service Provider or Customer, or for any loss arising from a cleaning service.

13.3 Without limiting 13.2, and because we are not a party to the contract for the cleaning service, Gwithva accepts no responsibility for any property damage, theft, loss, or personal injury arising from or in connection with a cleaning service arranged or managed through the Platform. Any such matter is the responsibility of the Service Provider and is to be resolved directly between the Service Provider and the Customer.

13.4 Subject to 13.1, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data. Subject to 13.1, our total liability to you in any 12‑month period is limited to the greater of (a) the fees you paid us in that period and (b) £100.

13.5 If you are a consumer, these Terms do not affect your statutory rights.

14. Indemnity (business users)

If you use the Platform in the course of a business (including Service Providers), you agree to indemnify us against claims arising from your breach of these Terms, your services, or content you upload.

15. Privacy

We process personal data in line with our Privacy Policy (section 2 of the legal pack) and Cookie Policy (section 3).

16. Suspension and termination

16.1 You may stop using the Platform and close your account at any time. Fees are covered by the Fees & Commission terms.

16.2 We may suspend or close your account if you breach these Terms, if we are required to by law, or if continuing to provide the Platform to you poses a risk to us or other users. Where reasonable and lawful, we will give notice.

16.3 We may also suspend or restrict your account, without prior notice, while we investigate suspected fraud, misuse, a safety concern, or a breach of these Terms or the Acceptable Use Policy. We will restore access if the concern is not upheld.

17. Complaints

Please contact us first at [email protected] so we can try to resolve any issue. Complaints about a cleaning service should be raised with the Service Provider.

18. General

18.1 Events outside our control (force majeure). We are not responsible for any delay or failure to perform, or for any loss, caused by circumstances beyond our reasonable control — including internet or network outages, hosting or third-party service failures, power failures, fire or flood, natural disasters, epidemics, industrial action, or government or regulatory action. 18.2 If any clause is found invalid, the rest continue to apply. 18.3 We may transfer our rights and obligations under these Terms (for example on a sale of the business); your rights are not affected. 18.4 No one other than you and us has any rights under these Terms. 18.5 These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland you can also bring proceedings in your local courts).
